Effects of improper punishment
If the King does not punish those that deserve punishment or punishes those that are innocent, such a King gets a bad name and also goes to hell.
To control the natural instinct of selfishness in the society, punishment is an essential aspect as stated by Acharya Chanakya. However, this sloka refers to the effects of improper use of this power of the Ruler. If a culprit is let free without being punished, it emboldens others to follow him and commit more crimes. If an innocent is punished wrongly, that too sends a message of incompetence or tyranny of the King. The ruler not just loses the faith of his subjects, he will also have to face punishment in hell.
The sloka talks about the seriousness with which rulers have to take their responsibilities, failing which consequences will be disastrous.
‘‘మానవునిలో సహజంగా ఉన్న స్వార్థపరత్వాన్ని నియంత్రించడానికి దండం ప్రధాన ఉపాయం’’, అంటాడు ఆచార్య చాణుక్యుడు. అందువల్ల పాలకుని కర్తవ్యాలలో ఒకటి ‘దండనం’. ఇదిలేకపోతే దొంగలను, దేశద్రోహులను నిగ్రహించలేం. అయితే వారిని కనిపెట్టి దండించటంలో రాజు ఎక్కడా పొరపడకూడదు. కార్యాలయాల్లో ఉద్యోగస్థులతో వ్యవహరించే అధికారి కూడా రాజు వంటివాడే. వారికి సహితం ఈ హెచ్చరిక వర్తిస్తుంది.
శ్లో।। అదండ్యాన్‍ దండయన్‍ రాజా
దండ్యాంశ్చెవాప్య-దండయన్‍ ।
అయశో మహదాప్నోతి
నరకం చైవగచ్ఛతి ।।
పాలకుడు దండింపాలసిన వారిని దండింపకపో••నా, దండింపకూడని వారిని దండించినా అపకీర్తిని, నరకాన్ని పొందుతాడు.
పాలకుడికి పక్షపాతం, రాగం, ద్వేషం పనికిరావనీ, దయాదాక్షిణ్యాలు ఉండాలనీ, సరియైన న్యాయనిర్ణయం చేయాలని మనువు ఆదేశం!
నిరపరాధి శిక్షింపబడకూడదు – అపరాధి తప్పించుకోకూడదు. అదే అధికారుల లక్ష్యం కావాలి.
మంచిమనిషికి మంచిపేరు రాకున్నా నష్టం లేదు కానీ – చెడ్డమనిషికి మంచిపేరు రాకూడదు. అది సమాజానికి నష్టం. అలాగే అపరాధిని వదిలేస్తే – అతడు మరిన్ని పాపకార్యాలు చేస్తే దానికి రాజు బాధ్యుడవుతాడు.
మంచివానికి పొరపడి శిక్ష విధిస్తే, సమాజం బాధపడుతుంది. మంచి అధికారిని బదిలీ చేసినప్పుడు, మంచి ఉద్యోగిని శిక్షించినప్పుడు సమాజంలో జరిగే ప్రతిస్పందన మనకు తెలుసు. ఓట్ల రాజకీయాలకు దాసులైన పాలకులు నిజాయితీగల అనేకమంది ప్రభుత్వ అధికారులను బదిలీ చేయటం ప్రజాస్వామ్యంలో జరుగుతూ ఉంటుంది. దానికి ఫలితాన్ని ఆ పాలనాధికారి అనుభవిస్తాడు కూడా!
